Welcome to Pawtería. This website and store are operated by Kivo AI, LLC, a Florida limited liability company doing business as Pawtería ("Pawtería," "we," "us"). By visiting getpawteria.com or placing an order, you agree to these Terms of Service. If you do not agree, please do not use the site.

1. Who can order

You must be at least 18 years old, or the age of majority where you live, to place an order. You agree to give us accurate contact, shipping and payment information.

2. What we make

We create personalized pet portraits, custom songs and related gift items from the photos and details you send us. Our artwork and songs are produced with AI-assisted tools and reviewed by our team. Each piece is an artistic interpretation, so it will not be an exact copy of your photo, and no two pieces are identical.

Printed products are made to order by our print partners in the United States. Colors on your screen and room previews are approximations; the printed piece may vary slightly in color, crop and size.

3. Your photos and details

You keep ownership of the photos and information you send us. You give us permission to use them to create, produce, deliver and support your order. You confirm that you have the right to share them, and that anyone who appears in them has agreed to be included.

Please do not upload content that is unlawful, infringes someone else's rights, or is sexually explicit, hateful or violent. We may decline or cancel any order that does not meet these rules and refund it.

4. Proofs and approval

Before anything is printed, we send you a proof to review. You can ask for revisions as described in our Refund Policy. Nothing prints until you approve. Once you approve your proof, your order goes into production and can no longer be changed or cancelled.

If we do not hear back from you about a proof, your order stays on hold; we never approve on your behalf.

5. Prices and payment

Prices are shown in U.S. dollars and may change at any time before you order. Taxes and shipping are added at checkout where they apply. Payment is taken when you place your order. We may refuse or cancel an order, for example if there is a pricing error or a suspected fraudulent payment, and we will refund anything you paid for it.

6. Shipping and delivery

Production and delivery times are estimates, not guarantees, and they start when you approve your proof. See our Shipping Policy for current times and holiday cutoffs. Risk of loss passes to you when the carrier receives your package; if a package is lost or arrives damaged, our Refund Policy explains how we make it right.

7. Returns and refunds

Because every piece is made just for you, returns and refunds are limited. Our Refund Policy is part of these Terms and explains cancellations, reprints for damaged or misprinted items, lost packages and digital files.

8. How you can use your portrait and song

Once your order is paid, you may use your finished portrait, song and digital files for personal, non-commercial purposes: display them, gift them and share them with family, friends and on your own social media. You may not resell them, license them to others or use them to promote a business without our written permission.

The Pawtería name, logo, website, art styles, templates and designs belong to us and are not transferred to you.

9. Digital files and song pages

Digital files and song pages are delivered by email or link after approval. We do our best to keep links available, but we cannot guarantee they will be hosted forever; please download and keep a copy of your files.

10. Disclaimers

Our site and products are provided "as is." To the fullest extent the law allows, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

11. Limit of liability

To the fullest extent the law allows, Pawtería and Kivo AI, LLC will not be liable for indirect, incidental, special or consequential damages, and our total liability for any claim related to an order is limited to the amount you paid for that order.

12. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Broward County, Florida, unless the law where you live requires otherwise.
